1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Caravaan.shop ("Platform," "Company," "we," "us," or "our"). By accessing, browsing, or using the Platform in any manner — including without limitation creating an account, listing products, or completing a purchase — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform.

2. Description of Service

Caravaan.shop operates as a global heritage marketplace that facilitates transactions between independent sellers ("Sellers") and buyers ("Buyers") of handcrafted goods — including but not limited to clothing, jewelry, rugs, saffron, spices, and cultural artefacts originating from the Silk Road region and beyond.

The Platform provides technology infrastructure, payment processing (via Stripe), and discovery tools. Caravaan.shop does not manufacture, warehouse, inspect, or ship any products listed on the Platform. All products are sold directly by Sellers, who bear sole responsibility for their listings and fulfillment obligations.

3. Eligibility

The Platform is available only to individuals who are at least eighteen (18) years of age or who have reached the age of majority in their applicable jurisdiction, whichever is greater. By creating an account, you represent and warrant that: (a) you meet the foregoing age requirement; (b) all registration information you submit is truthful, accurate, and complete; and (c) you will maintain the accuracy of such information.

4. Account Registration and Security

You are solely responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to: (a) maintain the confidentiality of your password; (b) immediately notify us of any unauthorized access or security breach; and (c) accept responsibility for all actions taken through your account, whether or not authorized by you.

We reserve the right to suspend, disable, or terminate any account at our sole discretion, including without limitation in cases of suspected fraud, abuse, or violation of these Terms.

5. Buyer Obligations

By placing an order on the Platform, you agree to pay the listed purchase price plus any applicable shipping fees and taxes. All payments are processed securely through Stripe's PCI-DSS compliant infrastructure. Upon successful payment, you will receive an order confirmation via email. Buyers acknowledge that delivery timelines, product specifications, and return policies are determined by the individual Seller and may vary.

6. Seller Obligations

Sellers are independent parties — not employees, agents, or representatives of Caravaan.shop. By listing products on the Platform, Sellers represent, warrant, and agree to the following:

  • All product listings, including titles, descriptions, pricing, and specifications, are accurate, complete, and not misleading.
  • All listed products comply with applicable local, national, and international laws and regulations, including but not limited to consumer protection, product safety, and trade compliance laws.
  • Sellers shall fulfill orders in a timely manner and provide accurate shipping and tracking information to Buyers.
  • Sellers are solely responsible for calculating and remitting any applicable sales tax, VAT, customs duties, or import/export taxes.

Sellers receive payouts through Stripe Connect. A platform service fee of 5% is deducted from the gross sale amount of each transaction to cover operating costs, payment processing, and platform maintenance.

7. Seller Content Responsibility

By uploading, submitting, or publishing any content to the Platform — including but not limited to product photographs, descriptions, logos, brand names, and any other materials ("Seller Content") — Sellers represent, warrant, and agree that:

  • Ownership and Authorization. Sellers either own all rights, title, and interest in the Seller Content, or have obtained all necessary licenses, permissions, consents, and authorizations from the rightful owner(s) to use, reproduce, display, and distribute such content on the Platform.
  • No Infringement. The Seller Content does not and shall not infringe, misappropriate, or violate any third party's intellectual property rights (including copyrights, trademarks, patents, and trade secrets), rights of publicity, rights of privacy, or any other proprietary or legal rights.
  • Accuracy and Authenticity. All Seller Content is truthful, accurate, and not deceptive or misleading. Product images accurately represent the actual item being sold and have not been manipulated in a manner that would mislead Buyers.
  • No Prohibited Content. Seller Content does not contain or promote: (a) counterfeit or unauthorized replica goods; (b) stolen property; (c) illegal substances or items; (d) hateful, defamatory, obscene, or otherwise objectionable material; or (e) content that violates any applicable law or regulation.
  • Indemnification. Sellers agree to indemnify, defend, and hold harmless Caravaan.shop, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) any Seller Content; (b) any alleged or actual infringement of third-party rights; or (c) any breach of these representations and warranties.
  • Acknowledgement. Prior to publishing any product listing, Sellers are required to expressly acknowledge and accept these content responsibility terms by checking the designated confirmation checkbox. This acknowledgement is recorded with a timestamp and constitutes the Seller's binding agreement to the obligations set forth in this section.

Caravaan.shop reserves the right, but assumes no obligation, to monitor, review, or remove any Seller Content at its sole discretion, with or without notice, for any reason including but not limited to suspected infringement, policy violations, or legal compliance.

8. Store Verification

All new Seller stores are subject to a verification review by Caravaan.shop prior to product listings becoming publicly visible on the Platform. Verification is conducted at our sole discretion and may consider factors including but not limited to: completeness of store profile, quality and authenticity of product listings, and compliance with these Terms.

Verification does not constitute an endorsement, guarantee, or certification of any Seller, product, or transaction. Caravaan.shop reserves the right to revoke verification status at any time, with or without cause, and to remove or suspend any store or listing that fails to meet our standards.

9. Payments, Fees, and Billing

All monetary transactions conducted through the Platform are denominated in United States Dollars (USD) and processed via Stripe. The Company does not collect, store, or have access to your payment card information — all payment data is handled exclusively by Stripe's PCI-DSS Level 1 compliant infrastructure.

Product prices are set exclusively by Sellers. Caravaan.shop does not control or influence product pricing and makes no representations regarding the fairness, accuracy, or competitiveness of any listed price.

10. Orders, Shipping, and Returns

Shipping timelines, methods, carriers, and costs are determined by individual Sellers and may vary based on origin, destination, and product type. Caravaan.shop does not control and is not responsible for shipping delays, customs holds, lost packages, or delivery failures.

Return and refund policies are established by individual Sellers. Buyers should review each Seller's policies prior to purchase and direct any order-related inquiries to the Seller through the Platform's messaging system.

11. Prohibited Conduct

In connection with your use of the Platform, you agree that you shall not:

  • Use the Platform for any purpose that is unlawful, fraudulent, or prohibited by these Terms.
  • List, sell, or facilitate the sale of counterfeit, stolen, hazardous, or legally prohibited items.
  • Harass, threaten, defame, intimidate, or abuse other Users.
  • Attempt to circumvent, disable, or interfere with payment processing or security features.
  • Use automated systems, bots, scrapers, or crawlers to access, extract, or index Platform content without prior written consent.
  • Impersonate any person, entity, or falsely represent your affiliation with any person or entity.
  • Upload or transmit viruses, malware, or any code of a destructive nature.
  • Engage in price manipulation, fake reviews, or any form of marketplace manipulation.

Violation of this section may result in immediate account termination, forfeiture of pending payouts, and referral to law enforcement authorities where applicable.

12. Intellectual Property

All Platform content — including but not limited to the Caravaan.shop name, logo, visual design, user interface, underlying code, and all associated intellectual property — is owned exclusively by Caravaan.shop or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws.

Sellers retain all ownership rights in their original Seller Content. By submitting Seller Content to the Platform, Sellers grant Caravaan.shop a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such content solely for the purposes of operating, promoting, and improving the Platform.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CARAVAAN.SHOP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

CARAVAAN.SHOP MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE QUALITY, SAFETY, LEGALITY, AUTHENTICITY, OR ACCURACY OF ANY PRODUCTS, LISTINGS, OR CONTENT PROVIDED BY SELLERS.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARAVAAN.SHOP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL CARAVAAN.SHOP'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM EXCEED THE TOTAL PLATFORM FEES ACTUALLY RECEIVED BY CARAVAAN.SHOP FROM THE DISPUTED TRANSACTION(S) DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Dispute Resolution

In the event of a dispute between a Buyer and Seller, both parties are encouraged to first attempt to resolve the matter amicably through the Platform's direct messaging system. Caravaan.shop may, at its sole discretion, assist in mediation efforts but is under no obligation to intervene or adjudicate disputes.

For payment-related disputes, Buyers may also avail themselves of Stripe's dispute resolution mechanisms or contact their card-issuing bank directly.

16. Termination

We reserve the right to suspend, restrict, or permanently terminate your account and access to the Platform at our sole discretion, without prior notice, for any reason, including but not limited to: suspected fraud, violation of these Terms, abusive behaviour, or inactivity.

Upon termination: (a) your right to access and use the Platform ceases immediately; (b) any pending Seller payouts will be processed in accordance with Stripe's applicable policies, subject to any holds or reserves required by law or contractual obligation; and (c) provisions of these Terms that by their nature should survive termination shall remain in full force and effect.

17. Modifications to Terms

Caravaan.shop reserves the right to modify, amend, or replace these Terms at any time. Material changes will be communicated by posting the revised Terms on this page with an updated "Last Revised" date. Your continued use of the Platform following the posting of any changes constitutes your acceptance of such changes. We encourage you to periodically review these Terms.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Caravaan.shop with respect to your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
